- For orders consisting of several Products with different availability dates that are to be delivered in a single shipment, the order processing time depends on when the Seller obtains the last Product included in the order, unless otherwise agreed with the Customer.
- The time required for delivery of the Product to the Customer by a carrier or by the Seller’s own transport must be added to the order processing time, depending on the delivery method selected by the Customer. - If the goods sold have a defect, the Customer may submit a statement reducing the price or withdrawing from the contract, unless the Seller replaces the defective goods with goods free from defects or remedies the defect without undue delay and without excessive inconvenience to the Customer. This restriction does not apply if the goods have already been replaced or repaired by the Seller, or if the Seller has failed to fulfil its obligation to replace the goods with goods free from defects or to remedy the defect.
- The Customer may request replacement of the goods with goods free from defects instead of the repair proposed by the Seller, or request repair instead of replacement, unless bringing the goods into conformity with the contract in the manner chosen by the Customer is impossible or would entail excessive costs compared with the method proposed by the Seller.
- The Customer may not withdraw from the contract if the defect is insignificant.
- If necessary for the assessment of physical defects, the Product must be delivered to: Grassland Horse Feeding Sp. z o.o., ul. Grabskiego 8, 37-450 Stalowa Wola, Poland.

- The right of withdrawal may be exercised within 14 calendar days from the date on which the Customer, or a third party other than the carrier and designated by the Customer, takes possession of the Product. If the contract covers several items delivered separately, in batches or in parts, the period begins when the last item, batch or part is taken into possession.
- The Customer may withdraw from the contract by submitting a withdrawal statement using the form provided in Annex 1 to these Terms and Conditions and sending it to the Seller’s address or by email to info@grassland.com.pl.
- To meet the deadline specified in point 3, it is sufficient to send the withdrawal statement before that deadline expires.
- The Seller will promptly confirm receipt of the withdrawal statement to the Customer.
- The Seller will reimburse all payments received from the Customer, including delivery costs, without undue delay and no later than 14 calendar days after receiving the withdrawal statement. The Seller will make the reimbursement using the same means of payment as the Customer used, unless the Customer has expressly agreed to another reimbursement method that does not entail any costs for the Customer.
- Unless the Seller has offered to collect the Product from the Customer, the Seller may withhold reimbursement until the Product has been received back or the Customer has supplied evidence of having sent it back, whichever occurs first.
- If the Customer selected a delivery method other than the least expensive standard delivery method offered by the Seller, the Seller is not required to reimburse the additional costs incurred by the Customer.
- The Customer must return the goods to the Seller or hand them over to a person authorised by the Seller without undue delay and no later than 14 calendar days after the day on which the Customer withdrew from the contract, unless the Seller has offered to collect the Product. The deadline is met if the Product is sent back before that period expires.
- The Customer bears only the direct cost of returning the Product.
- The Product must be delivered to the Seller at: Grassland Horse Feeding Sp. z o.o., ul. Grabskiego 8, 37-450 Stalowa Wola, Poland.

- In the event of withdrawal from the contract, the Consumer is liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.
- The Customer has no right to withdraw from the contracts specified in Article 38 of the Polish Consumer Rights Act of 30 May 2014, including contracts:
a) for the supply of goods that are not prefabricated and are made to the Consumer’s specifications or tailored to their individual needs;
b) for the supply of goods which, after delivery, become inseparably mixed with other items due to their nature;

d) for the supply of goods that are liable to deteriorate or expire rapidly.
§9. WITHDRAWAL FROM ELECTRONIC SERVICE CONTRACTS AND COMPLAINTS CONCERNING ELECTRONIC SERVICES
- For contracts for the continuous provision of electronic services concluded for an indefinite term, such as a Customer Account or Newsletter, the Customer has the right to terminate the contract. The Customer may terminate the contract with immediate effect and without giving any reason by sending a termination notice to info@grassland.com.pl.
- The Seller reserves the right to terminate a contract for the continuous provision of electronic services concluded for an indefinite term by giving 14 days’ notice if the Customer breaches these Terms and Conditions.
- If the Seller fails to provide, or improperly provides, services through the Online Store, the Customer may submit a complaint by email to info@grassland.com.pl.
- A properly submitted complaint should include the Customer’s identification details, namely their full name or company name, residential address or registered office address, and email address; the subject of the complaint, including the period to which it relates; and the circumstances justifying the complaint.
- The Seller will consider the complaint within 14 calendar days of receiving it.
§10. PROVISIONS APPLICABLE TO BUSINESS CUSTOMERS
- The provisions of this section apply only to Customers who are not Consumers within the meaning of Article 22¹ of the Polish Civil Code.
- The provisions of this section do not apply to Sales Contracts where the purchaser is a natural person entering into a contract directly related to their business activity and the content of that contract indicates that it is not of a professional nature for that person, as determined in particular by the scope of their business activity disclosed pursuant to the provisions governing the Polish Central Register and Information on Economic Activity (CEIDG).
- The Seller reserves the right to withdraw from the Sales Contract at any time, provided that the Product has not been handed over to the Customer, a third party acting on the Customer’s behalf or the carrier delivering the Product to the Customer. Withdrawal from the contract by the Seller does not give rise to any claims by the Customer against the Seller.
- The Seller reserves the right to restrict the payment methods available in the Online Store. The Seller reserves the right to require advance payment of all or part of the order value, regardless of the payment method selected by the Customer. Pursuant to Article 558 of the Polish Civil Code, the Seller’s liability under the statutory warranty for defects is excluded where the Product is sold to a Customer who is not a Consumer.
- Pursuant to Article 548 §1 of the Polish Civil Code, the benefits and burdens associated with the Product and the risk of accidental loss of or damage to the Product pass to the Customer when the Seller hands over the Product to the Customer, a third party designated by the Customer or the carrier.
- The Seller’s liability to the Customer is limited to actual losses incurred by the Customer as a result of the Seller’s improper performance of the contract. The Seller’s liability may not exceed the value of the order placed by the Customer.
§11. SELLER’S LIABILITY
- The Seller is not liable for incorrect information entered by the Customer, in particular incorrect information provided in forms available on the website, or for actions by the Customer that hinder or prevent the Seller from providing and performing services.

Use of this content without the Seller’s written consent gives rise to civil and criminal liability.
- The Customer may use content published in the Online Store only for their own personal use. Any other use is permitted only where expressly authorised by the Seller.
- Use of the Online Store, including the use of text, graphics, photographs, applications, databases or other content, does not grant the Customer any rights to that content and, in particular, does not constitute the acquisition of economic copyrights, related rights or licences.
- The following activities are prohibited without the Seller’s express consent:
a) copying, modifying or transmitting, electronically or otherwise, the Online Store or any part of it, or individual items of content made available through it;
b) distributing content published in the Online Store by any means;
c) extracting and reusing all or part of the contents of databases.
§13. FINAL PROVISIONS

Amendments to these Terms and Conditions do not apply to Customers who placed an order while the previous version was in force. Amendments made during an ongoing contractual relationship are binding on the other party if the requirements of Article 384 of the Polish Civil Code have been met and that party has not terminated the contract within the 14-calendar-day notice period.
- Matters not governed by these Terms and Conditions are subject to the relevant provisions of Polish law. Where the provisions applicable in the Consumer’s country are more favourable to the Consumer and cannot be excluded by contract, those provisions will apply to the contract concluded through the Online Store.
- The Customer may use out-of-court procedures for handling complaints and pursuing claims arising from orders placed in the Store. These include: in disputes concerning property rights arising from sales contracts and service contracts, applying for the case to be heard by the Permanent Consumer Arbitration Court operating at the relevant Provincial Inspectorate of Trade Inspection; or applying to the Provincial Inspector of Trade Inspection in Bydgoszcz (https://www.wiih.com.pl) for steps to be taken to resolve the dispute out of court under the Polish Act of 23 September 2016 on Out-of-Court Resolution of Consumer Disputes (Journal of Laws of 2016, item 1823).
